Privacy Policy for California Residents

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in the Privacy Policy of Lifekind Health, Inc. and its subsidiaries (collectively, “we,” “us,” or “our”) and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.
Information We Collect
We collectinformation that identifies, relates to, describes, references, is capable ofbeing associated with, or could reasonably be linked, directly or indirectly,with a particular consumer or device (“personal information”). In particular,we have collected the following categories of personal information fromconsumers within the last twelve (12) months:

o personalinformation covered by certain sector-specific privacy laws, including the FairCredit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or CaliforniaFinancial Information Privacy Act (FIPA), and the Driver’s Privacy ProtectionAct of 1994.
We obtainthe categories of personal information listed above from the followingcategories of sources:
· Directlyand indirectly from activity on our website (https://lifekind.webflow.io/). Forexample, from submissions through our website portal or website usage detailscollected automatically.
· Weuse Jotform as a third-party service provider to power our online forms.Jotform may collect personal information you submit through forms on ourwebsite, including information that may be considered ProtectedHealth Information (PHI)under the Health Insurance Portability and Accountability Act (HIPAA).
· Wehave entered into a Business Associate Agreement (BAA) with Jotform and use its HIPAA-compliantplatform toensure that your information is collected, transmitted, and stored securely andin accordance with federal privacy laws.
· Jotformprocesses your information solely for the purpose of securely transmitting yoursubmissions to us and does not access or use your information for any otherpurpose. For more information, you can visit Jotform’s Privacy Policy.
· Fromthird parties that interact with us in connection with the services we perform.For example, from government agencies when we prepare readiness assessments forprojects that receive government funding.
ProtectedHealth Information and HIPAA
Some ofthe personal information we collect may constitute Protected Health Information(PHI) under the Health Insurance Portability and Accountability Act of 1996(HIPAA). PHI is health-related information that can be used to identify you andthat relates to your past, present, or future physical or mental health,treatment, or payment for healthcare services.
We are a"covered entity" under HIPAA, which means we must comply with strictrules for the use, disclosure, and protection of PHI. These obligations areseparate and distinct from your rights under the California Consumer PrivacyAct (CCPA).
When wecollect or receive PHI in our role as a healthcare provider (for example,through appointment scheduling, referrals, or telehealth communications), thatinformation is governed by our Notice of Privacy Practices [EH1] and not by this CCPA PrivacyPolicy.

Use ofPersonal Information
We may useor disclose the personal information we collect for one or more of thefollowing business purposes:
1. Tofulfill or meet the reason for which the information is provided.
2. Toprovide you with information that you request from us.
3. Toprovide you with email alerts, event registrations and other notices concerningour products or services, or events or news, that may be of interest to you.
4. Toimprove our website and present its contents to you.
5. Fortesting, research, analysis and product development.
6. Asnecessary or appropriate to protect the rights, property or safety of us, orothers.
7. Torespond as required by applicable law, court order, or governmentalregulations.
8. Asdescribed to you when collecting your personal information or as otherwise setforth in the CCPA.
9. Toevaluate or conduct a merger, divestiture, restructuring, reorganization,dissolution, or other sale or transfer of some or all of our assets, whether asa going concern or as part of bankruptcy, liquidation, or similar proceeding,in which personal information held by us is among the assets transferred.
We willnot collect additional categories of personal information or use the personalinformation we collected for materially different, unrelated, or incompatiblepurposes without providing you notice.
SharingPersonal Information
We maydisclose your personal information to a third party for a businesspurpose. When we disclose personal information for a business purpose, weenter a contract that describes the purpose and requires the recipient to bothkeep that personal information confidential and not use it for any purposeexcept performing the contract.
In thepreceding twelve (12) months, we have disclosed the following categories ofpersonal information for a business purpose:

YourRights and Choices
The CCPAprovides consumers (California residents) with specific rights regarding theirpersonal information. This section describes your CCPA rights and explains howto exercise those rights.
Accessto Specific Information and Data Portability Rights
You havethe right to request that we disclose certain information to you about ourcollection and use of your personal information over the past 12 months. Oncewe receive and confirm your verifiable consumer request, we will disclose toyou:
· Thecategories of personal information we collected about you.
· Thecategories of sources for the personal information we collected about you.
· Ourbusiness or commercial purpose for collecting or selling that personalinformation.
· Thecategories of third parties with whom we share that personal information.
· Thespecific pieces of personal information we collected about you (also called adata portability request).
· Ifwe sold or disclosed your personal information for a business purpose, twoseparate lists disclosing:
o sales,identifying the personal information categories that each category of recipientpurchased; and
o disclosuresfor a business purpose, identifying the personal information categories thateach category of recipient obtained.
Rightto Correct Inaccurate Personal Information
You havethe right to request that we correct inaccurate personal information that wemaintain about you, taking into account the nature of the personal informationand the purposes of the processing.
DeletionRequest Rights
You havethe right to request that we delete any of your personal information that wecollected from you and retained, subject to certain exceptions. Once we receiveand confirm your verifiable consumer request, we will delete (and direct ourservice providers to delete) your personal information from our records, unlessan exception applies.
We maydeny your deletion request if retaining the information is necessary for us orour service providers to:
1. Completethe transaction for which we collected the personal information, provide a goodor service that you requested, take actions reasonably anticipated within thecontext of our ongoing business relationship with you, or otherwise perform ourcontract with you.
2. Detectsecurity incidents, protect against malicious, deceptive, fraudulent, orillegal activity, or prosecute those responsible for such activities.
3. Debugproducts to identify and repair errors that impair existing intendedfunctionality.
4. Exercisefree speech, ensure the right of another consumer to exercise their free speechrights, or exercise another right provided for by law.
5. Complywith the California Electronic Communications Privacy Act (Cal. Penal Code §1546 seq.).
6. Engagein public or peer-reviewed scientific, historical, or statistical research inthe public interest that adheres to all other applicable ethics and privacylaws, when the information’s deletion may likely render impossible or seriouslyimpair the research’s achievement, if you previously provided informed consent.
7. Enablesolely internal uses that are reasonably aligned with consumer expectationsbased on your relationship with us.
8. Complywith a legal obligation.
9. Makeother internal and lawful uses of that information that are compatible with thecontext in which you provided it.
ExercisingAccess, Data Portability, and Deletion Rights
Toexercise the access, data portability, and deletion rights described above,please submit a verifiable consumer request to us by either:

Only youor a person registered with the California Secretary of State that youauthorize to act on your behalf, may make a verifiable consumer request relatedto your personal information. You may also make a verifiable consumer requeston behalf of your minor child.
You mayonly make a verifiable consumer request for access or data portability twicewithin a 12-month period. The verifiable consumer request must:
· Providesufficient information that allows us to reasonably verify you are the personabout whom we collected personal information or an authorized representative.
· Describeyour request with sufficient detail that allows us to properly understand,evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We willnot discriminate against you for exercising any of your CCPA rights. Unlesspermitted by the CCPA, we will not:
· Denyyou services.
· Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties.
· Provide you a different level or quality of services.
· Sugges tthat you may receive a different price or rate for services or a different level or quality of services.
Changesto Our Privacy Notice
We reservethe right to amend this privacy notice at our discretion and at any time. Whenwe make changes to this privacy notice, we will notify you by email or througha notice on our website homepage.
We do notsell or share your personal information as defined under the CCPA andCalifornia Privacy Rights Act. If this changes in the future, we will updatethis notice and provide a “Do Not Sell or Share My Personal Information” linkon our website as required by law.
